The ‘Asbestos: the survey guide’ HSG 264, has replaced the ‘MDHS 100’. ‘Type 1, 2 and 3’ surveys have been replaced by two new types of survey:
‘Management’ Survey continued use of the building, survey all accessible areas:
Walls, ceilings, pipes, boilers, cladding, Lift shafts, inside risers, service ducts, above false ceilings, tunnels. Areas not inspected must be presumed to contain asbestos
‘Refurbishment/Demolition’ Survey (includes “minor” refurbishment)
Used to locate ALL Asbestos Containing Materials in ALL areas. Structural locations, Break through walls, ceilings, cladding, partitions, Inside cavity walls, ducts and tunnels; under floor tiles. Needed for home improvement programmes such as new kitchens, bathrooms, electrics, plumbing, windows, roofs.
Control of Asbestos Regulations 2006
The duty to manage asbestos in non-domestic buildings is contained in regulation 4 of the Control of Asbestos Regulations 2006. In many cases, the ‘duty holder’ is the person or organisation that has clear responsibility for the maintenance or repair of non-domestic premises through an explicit agreement such as a tenancy agreement or contract.
The Control of Asbestos Regulations 2006 came into force on 13 November 2006
(Asbestos Regulations - SI 2006/2739)
These Regulations bring together the three previous sets of Regulations covering the prohibition of asbestos, the control of asbestos at work and asbestos licensing.
The Regulations prohibit the importation, supply and use of all forms of asbestos. They continue the ban introduced for blue and brown asbestos in 1985 and for white asbestos in 1999. They also continue to ban the second-hand use of asbestos products such as asbestos cement sheets and asbestos boards and tiles; including panels which have been covered with paint or textured plaster containing asbestos.
The ban applies to new use of asbestos. If existing asbestos containing materials are in good condition, they may be left in place, their condition monitored and managed to ensure they are not disturbed.
Duty to manage asbestos
The Asbestos Regulations also include the 'duty to manage asbestos’ in non-domestic premises.
